ORDINANCE TO AUTHORIZE A SHARED SERVICES AGREEMENT BETWEEN THE CITY OF GAHANNA AND CITY OF NEW ALBANY FOR MAYOR'S COURT SERVICES AND TO DECLARE AN EMERGENCY.

WHEREAS, the Ohio Revised Code Chapter 1905 provides for municipalities to conduct Mayor's Courts; and
WHEREAS, collaborative and shared services are beneficial to the municipalities in Ohio; and
WHEREAS, the City of New Albany has elected to have their Mayor's Court located at and their Clerk of Court functions performed by the City of Gahanna, in exchange for a negotiated fee; and
WHEREAS, the execution of this Shared Services Agreement is a timely matter in that the Supreme Court of Ohio has quarterly reporting requirements that must be transferred by the City of New Albany to the City of Gahanna as of July 1, 2021; and
WHEREAS, it is imperative to proceed with this Ordinance for the preservation of the public peace, property, health, safety, and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into a shared services agreement with the City of New Albany, 99 West Main Street, New Albany, Ohio 43054, for the City of Gahanna to hold and conduct the Mayor's Court for the City of New Albany, said Shared Services Agreement is attached hereto as EXHIBIT A, and made a part herein.
Section 2. That the Shared Services Agreement is effective upon signature of both parties after authorization by both City Councils, but in any event no later than July 1, 2021, and expires December 31, 2024, unless renewed pursuant to its terms.
Section 3. That the compensation to the City of Gahanna shall be as set forth in said Shared Services Agreement.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approv...
