ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AMENDED LEASE AGREEMENT WITH TOWERCO 2013, LLC.

WHEREAS, City Council passed Ordinance, ORD-0098-2017 to authorize a lease agreement with TOWERCO 2013, LLC for a personal wireless communication facility located at the Gahanna Municipal Golf Course; and
WHEREAS, City Council passed Ordinance, ORD-0036-2018 to authorize the amendment to the agreement with TOWERCO 2013, LLC for a personal wireless communication facility located at the Gahanna Municipal Golf Course; and
WHEREAS, the Director of Parks & Recreation has recommended changes to the agreement to extend the period of time to perform; and
WHEREAS, it is imperative to move forward with this legislation all for the preservation of the public peace, property, health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into amended lease agreement with TOWERCO 2013, LLC; said Amended Agreement attached hereto as EXHIBIT A, and made a part herein.
SECTION 2. That this Ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
