AN ORDINANCE TO AUTHORIZE THE MAYOR TO ENTER INTO AN EASEMENT AND RIGHT-OF-WAY AGREEMENT WITH MI HOMES FOR THE PURPOSES OF A PATHWAY INTO HANNAH PARK.

WHEREAS, Gahanna is the owner of certain property located in Gahanna, Franklin County, Ohio and known as of the date of this Agreement as Franklin County Parcel Number 027-000077-00; and
WHEREAS, Gahanna desires to grant a nonexclusive easement over it’s land, more particularly described in Exhibit A and depicted in Exhibit B attached hereto,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO;
Section 1. That the Mayor is hereby authorized to enter into a non-exclusive easement agreement with MI Homes and said easement attached hereto as EXHIBIT A, and made a part herein.
Section 2. That the Mayor is hereby authorized to enter into a compensation agreement with MI Homes, attached hereto as EXHIBIT B, and made a part herein.
Section 3. That this Ordinance shall be in full force and effect upon passage by this Council and 30 days after date of signature approval by the Mayor.
