TO AUTHORIZE THE MAYOR TO SIGN ADDENDUM #1 WITH RUMPKE OF OHIO, INC., FOR RESIDENTIAL REFUSE, RECYCLING & YARD WASTE COLLECTION IN THE CITY OF GAHANNA; AND TO DECLARE AN EMERGENCY.

WHEREAS, on November 5, 2018 (ORD-0082-2018), Council approved legislation that authorized the Mayor to enter into a contract with Rumpke of Ohio, Inc. for solid waste collection for years 2019, 2020, and 2021; and
WHEREAS, on November 26, 2018, the City received Addendum #1 to the current contract, which reiterates that the contract is only for 3 years and that the optional extension years of 2022 and 2023 may be mutually agreed upon by both parties at an adjusted rate; and
WHEREAS, the Addendum also states that Rumpke will not be responsible for maintaining or replacing community provided carts unless we are paying the surcharge fee for maintenance of those carts; and
WHEREAS, it is imperative to move forward with this legislation, so that the Addendum is valid and in effect January 1, 2019 for solid waste collection services, and all for the preservation of the public peace, property, health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to sign Addendum #1 with RUMPKE WASTE & RECYCLING SERVICES, 1191 Fields Avenue, Columbus, Ohio 43201, for collection of residential refuse, recycling, and yard waste in the City of Gahanna; said Addendum #1 attached as EXHIBIT A, and made a part herein.
Section 2. That funding will be set aside in the 2019 Appropriations, as well as subsequent years, to cover any herein costs.
Section 3. That, for the reasons set forth in the preamble hereinabove, this Ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
