TO ENACT CODE CHAPTER 732, MOBILE FOOD VENDING (MFV), AND TO REPEAL CODE CHAPTER 733, STREET FOOD VENDORS, OF PART SEVEN, BUSINESS REGULATION CODE, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA.

BODY

WHEREAS, the purpose of the proposed Mobile Food Vending (MFV) code is to replace the outdated provisions of Chapter 733 [Street Food Vendors - Passed 08-03-1982] with more contemporary language in order for the City to more effectively regulate the operation of Mobile Food Vendors (i.e. food trucks) within the public right of way and on private property; and

WHEREAS, the proposed code would recognize and require that MFV operators wishing to operate within the City of Gahanna be fully licensed and inspected through the City of Columbus Licensing Section; and

WHEREAS, Columbus has a very robust licensing process that incorporates best-practices for MFV operators to include background checks of licensed operators as well as health, fire and safety inspections; and

WHEREAS, the Columbus process has established an advisory board comprised of City officials as well as MFV vendors; and

WHEREAS, the proposed code would only require a fee paid to the City if a MFV operator wishes to operate within the public right of way, but no fees would apply for operation on private property; and

WHEREAS, the proposed code also provides for a mobile reservation system that would be the same system as in use by the City of Columbus and offer the ability to schedule and regulate spaces within the public right of way; and

WHEREAS, such a system would be available to the public and further promote food trucks and other mobile food vendors within the City.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
