TO DECLARE THE NECESSITY AND INTENT TO APPROPRIATE CERTAIN REAL ESTATE FOR PRICE ROAD SANITARY SEWER PHASE II SANITARY SEWER ASSESSMENT PROJECT.

 

BODY

 

WHEREAS, in order to assist impacted residents with paying connection fees when for the Price Road Sanitary Sewer Phase II project, the City would like to create a voluntary assessment that allows those impacted residents to pay their connection and capacity fees via property tax assessment over the next twenty (20) years; and

 

WHEREAS, in an effort to protect the health, safety, and well-being of our community, legislation is needed to assess the property.

 

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

 

Section 1. That this Council hereby declares the necessity and intent to appropriate certain real estate for the Price Road Sanitary Sewer Phase II Sanitary Sewer Assessment Project; pursuant to and in accordance with the Codified Ordinances of the City of Gahanna, the Charter of the City of Gahanna, and the Constitution of the State of Ohio, Chapter 719 and Chapter 163, Ohio Revised Code, said parcels more particularly described in EXHIBIT A, attached hereto and made a part herein.

 

Section 2. That the Department of Public Service & Engineering is hereby authorized and directed to cause a written notice of the adoption of this Resolution to be given to the owner/s/, person/s/, in possession of and person/s/ having a real or possible interest of record in the premises, and said notice shall be served by the Department of Public Service & Engineering, who shall make return of said service of notice in the manner provided by law.

 

Section 3. That this Resolution shall be in full force and effect upon passage by this Council and 30 days from date of signature approval by the Mayor.
