TO AUTHORIZE THE MAYOR TO ENTER INTO RECIPROCAL EASEMENT AGREEMENT WITH STAG, LLC. FOR BRICKLAWN AVENUE.
BODY
WHEREAS, currently a portion of Bricklawn Avenue at the intersection of Leavitt Service Road is located outside the public right-of-way on the property of Stag, LLC; and
WHEREAS, this area, if unaddressed, technically severs our access to all of Bricklawn Avenue; and
WHEREAS, in an effort to secure easement/right-of-way for our roadway, we have contacted Stag, LLC. regarding their interest in dedicating such right-of-way or easement and they have agreed to grant the requested easement in exchange for a reciprocal easement over the on-street parking located on Bricklawn Avenue; and
WHEREAS, we will be granted rights to the parking area and Stag, LLC. will acquire all maintenance responsibilities of the parking area.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section. 1. That the Mayor is hereby authorized to enter into Reciprocal Easement Agreement with Stag, LLC. for Bricklawn Avenue; said Agreement attached hereto as EXHIBIT A, and made a part herein.
Section 2. That this Ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
