TO AUTHORIZE THE MAYOR TO EXECUTE A UTILITY EASEMENT WITH WIDEOPENWEST OHIO, LLC TO RELOCATE THEIR POINT OF PRESENCE (POP) FOR GAHANNANET ONTO CITY OWNED PROPERTY; AND TO DECLARE AN EMERGENCY.
BODY
WHEREAS, a utility easement is necessary to allow WideOpenWest, Ohio, LLC (WOW) to install the necessary infrastructure to relocate the Point of Presence (POP) onto City owned property; and
WHEREAS, it is desirable to expedite the construction of the infrastructure that is dependent upon receiving this easement, and all for the preservation of the public peace, property, health, safety and welfare.
NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to execute a Utility Easement with WideOpenWest, Ohio, LLC, to relocate their Point of Presence (POP) for GahannaNet onto City owned property; said Utility Easement attached hereto as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preamble hereinabove, this Ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
