TO AMEND CHAPTER 1181, PERSONAL WIRELESS SERVICE FACILITIES, OF PART ELEVEN, PLANNING AND ZONING CODE, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA.

WHEREAS, Chapter 1181, Personal Wireless Service Facilities, of the Codified Ordinances of the City of Gahanna, has been amended; and
WHEREAS, the purpose of this amendment is to ensure that the Codified Ordinances are up-to-date protecting the health, safety, and welfare of the public while taking into account the current technology, practice, and environment of the wireless industry which will allow the City of Gahanna to operate as a competitive wireless marketplace; and
WHEREAS, the Planning Commission held public hearings on June 8 and June 22, 2016, in regular meeting sessions, said meetings held pursuant to notice and according to law; and
WHEREAS, the Planning Commission has reviewed the code and has made a recommendation on June 22, 2016, to Council for adoption of this code; and
WHEREAS, City Council held a public hearing on July 18, 2016, in regular meeting session, said meeting held pursuant to notice and according to law.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That Chapter 1181, Personal Wireless Service Facilities, is hereby enacted as set forth in EXHIBIT A, attached hereto and made a part herein.
Section 2. That Part Eleven, Planning and Zoning Code, of the Codified Ordinances of the City of Gahanna is hereby amended to reflect this new Chapter.
Section 3. That this Ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
