TO AUTHORIZE THE MAYOR TO SIGN AN AMENDED OPTICAL FIBER USE AGREEMENT WITH GAHANNA-JEFFERSON PUBLIC SCHOOL DISTRICT FOR INDEFEASIBLE RIGHT OF USE (IRU); AND TO DECLARE AN EMERGENCY. 

 

Body

 

WHEREAS, City Council previously authorized the Mayor to enter into said Optical Fiber Use Agreement with Gahanna Jefferson City School District (see ORD-0199-2010) for the use of the existing optical fiber system; and

 

WHEREAS, the Gahanna-Jefferson Public School District has requested connectivity through use of the City’s fiber optic network from Gahanna Lincoln High School to Blacklick Elementary School; and

 

WHEREAS, connectivity is possible through our existing fiber infrastructure and the Columbus Traffic Signal System (CTTS); and

 

WHEREAS, the City is willing to provide optical fiber strands and to grant Gahanna Jefferson Schools an Indefeasible Right of Use (IRU) through Optical Fiber Use Agreement; and

 

WHEREAS, it is imperative to move forward with this Ordinance so that the schools can access the fiber as soon as possible, and all for the preservation of the public peace, property, health, safety and welfare.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to sign an amended OPTICAL FIBER USE AGREEMENT, with the GAHANNA-JEFFERSON PUBLIC SCHOOL DISTRICT, 160 South Hamilton Road, for fiber strands within the City of Gahanna fiber network; said agreement attached as EXHIBIT A, and made a part herein.

 

Section 2.  That, for the reasons set forth in the preamble herein above, this Ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date signature approval by the Mayor.
