TO AUTHORIZE THE DIRECTOR OF FINANCE TO ESTABLISH A NEW COURT COMPUTERIZATION FUND FOR THE PURPOSE OF DEPOSITING CASH PROCEEDS FROM CASES HEARD IN THE MUNICIPAL MAYOR’S COURT.

WHEREAS, the Clerk of Court has established a new fee under Ohio Revised Code (ORC) section 1901.261(A) for computerization of the court; and
WHEREAS, the fee is in addition to the fee already established under City Charter Code 133.093 and ORC 1901.261(B) and is established at $3.00, which is the maximum allowed under the code; and
WHEREAS, fees collected are required to be placed in a special fund for the purpose of court computerization; and
WHEREAS, ORC 1901.261(A) requires legislation to establish a new fund for the purpose of depositing cash proceeds from cases heard in the Municipal Mayor’s Court; and
WHEREAS, proceeds received under this code are required to be used to computerize the court, to make available computerized legal research services, or do both.
NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Director of Finance is hereby authorized to establish a new Court Computerization Fund for the purpose of depositing cash proceeds from cases heard in the Municipal Mayor’s Court.
Section 2. That this Ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
