TITLE

TO DECLARE THE NECESSITY AND INTENT TO APPROPRIATE CERTAIN REAL ESTATE AT 297 WEST JOHNSTOWN ROAD FOR SANITARY SEWER SERVICES.

BODY

WHEREAS, the property located at 297 West Johnstown Road, Parcel ID No. 025-000902 has a failing septic system and was ordered by the Franklin County Board of Health to tie into sanitary sewer; and

WHEREAS, the owner of said property has expressed financial hardship in the ability to pay for both the construction and of the necessary sewer lateral and the cost of the related tap fees and has therefore requested and agreed to the fees for connecting into the sewer be assessed and added to the property tax over a 20 year period; and

WHEREAS, in an effort to protect the health, safety, and well-being of our community, legislation is needed to assess the property for the costs of the aforementioned tap fees.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

Section 1. That this Council hereby declares the necessity and intent to appropriate certain real estate for property located at 297 West Johnstown Road, Parcel ID No. 025-000902 for extension of sanitary sewer by the City; pursuant to and in accordance with the Codified Ordinances of the City of Gahanna, the Charter of the City of Gahanna, and the Constitution of the State of Ohio, Chapter 719 and Chapter 163, Ohio Revised Code, said parcels more particularly described in EXHIBIT A, attached to this resolution and made a part herein.

Section 2. That the City Attorney or their representative is hereby authorized and directed to cause a written notice of the adoption of this Resolution to be given to the owner/s/, person/s/, in possession of and person/s/ having a real or possible interest of record in the premises described in EXHIBIT A, herein, and said notice shall be served by said City Attorney or their representative, who shall make return of said service of notice in the manner provided by law....
