TO AUTHORIZE THE MAYOR TO ENTER INTO EASEMENT AND RIGHT-OF-WAY AGREEMENT WITH AEP FOR THE PURPOSES OF RELOCATING A UTILITY GUY POLE.

WHEREAS, the City is moving forward with the Big Walnut Trail, Section 5, realignment; and
WHEREAS, the relocation of the utility guy pole is necessary for the realignment of the trail; and
WHEREAS, the relocated pole requires an area just beyond the right-of-way in McCorkle Park, thus a private easement agreement is necessary to facilitate the new location; and
WHEREAS, the Director of Parks and Recreation is requesting authorization for the Mayor to grant a non-exclusive easement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO;
Section 1. That the Mayor is hereby authorized to enter into a non-exclusive easement agreement with AEP for the purposes of relocating a utility guy pole, said easement attached hereto as EXHIBIT A, and made a part herein.
Section 2. That this Ordinance shall be in full force and effect upon passage by this Council and 30 days after date of signature approval by the Mayor.
