TO AUTHORIZE THE MAYOR TO ENTER INTO A NON-EXCLUSIVE EASEMENT AGREEMENT WITH AT&T FOR THE PURPOSES OF RELOCATING A UTILITY POLE LINE.

WHEREAS, the City is moving forward with the Big Walnut Trail, Section 5, realignment; and
WHEREAS, currently there is a utility pole line owned by AT&T that needs relocated slightly to the east to accommodate the trail realignment; and
WHEREAS, the new pole location is just out of the right-of-way, thus a private easement is required on the Gahanna Golf Course parcels to facilitate the move; and
WHEREAS, the Director of Parks and Recreation is requesting authorization for the Mayor to grant a non-exclusive easement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO;
Section 1. That the Mayor is hereby authorized to enter into a non-exclusive easement agreement with AT&T for the purposes of relocating a utility pole line, said easement attached hereto as EXHIBIT A, and made a part herein.
Section 2. That this Ordinance shall be in full force and effect upon passage by this Council and 30 days after date of signature approval by the Mayor.
