TO AUTHORIZE THE MAYOR TO EXECUTE AMENDMENT TO CROSS ACCESS EASEMENT AGREEMENT WITH GEORGE E. PARKER JR. AND VIVIAN M. PARKER FOR THE BIG WALNUT TRAIL, SECTION 5.
BODY
WHEREAS, George E. Parker, Jr. and Vivian M. Parker have plans for their property for which the existing boardwalk easement authorized by ORD-0153-2004 interferes; and
WHEREAS, this existing easement area is not conducive to the construction of the main trail, for which it was originally intended, due to the large wetland area in this section; and
WHEREAS, the Director of Parks and Recreation has recommended that the City amend the current cross access agreement with George E. Parker, Jr. and Vivian M. Parker authorized by ORD-0153-2004;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to execute amendment to cross access easement agreement with GEORGE E. PARKER JR. AND VIVIAN M. PARKER for the Big Walnut Trail, Section 5; said Amendment and Maps attached hereto as EXHIBIT A and made a part herein.
Section 2. That this Ordinance shall be in full force and effect upon passage by this Council and 30 days after date of signature approval by the Mayor.
