TO ACCEPT DEED OF EASEMENT FOR SANITARY AND STORM SEWERS IN CHERRY COURT; SUBDIVISION; FROM DONELSON BUILDERS INC.

WHEREAS, an easement for construction, using and maintaining a sanitary and storm sewer were obtained in 1961 from Donelson Builders, Inc; and
WHEREAS, said utility easement was recorded on March 10, 1964 by the Franklin County Recorder's Office; and
WHEREAS, said utility easement was never accepted by the City of Gahanna;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby accepts the Deed of Easement from Donelson Builders Inc., for utility purposes in Cherry Court Subdivision, said land more particularly described in EXHIBIT A attached hereto and made a part herein.
Section 2. That this ordinance shall be in full force and effect at the earliest period allowed by law.
