TO AUTHORIZE THE MAYOR TO ENTER INTO OHIO ENVIRONMENTAL PROTECTION AGENCY CLEAN WATER ACT SECTION 319 GRANT AGREEMENT; NONPOINT SOURCE IMPLEMENTATION; FOR SYCAMORE RUN STREAM RESTORATION.

WHEREAS, the City, in conjunction with the Sycamore Woods Condominium Association, identified a degraded segment of Sycamore Run with rapidly eroding channel banks; and
WHEREAS, in 2012 the City applied for a Section 319(h) Nonpoint Source Implementation Grant, administered by the Ohio EPA, and received the award of that grant for $202,917; and
WHEREAS, the City and the Sycamore Woods Condominium Association will be responsible for the remaining 40% of the project costs with donated easements from both the City and the SWCA, and a contribution of approximately $5,000 from the SWCA, with the City picking up the balance; and
WHEREAS, legislation to authorize entering into the Grant Agreement with the EPA is necessary;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into OHIO ENVIRONMENTAL PROTECTION AGENCY CLEAN WATER ACT SECTION 319 GRANT AGREEMENT with the Ohio Environmental Protection Agency, 50 Town Street, Suite 700, Columbus, OH 43216-1049; Grant Agreement attached as EXHIBIT A, and made a part herein.
Section 2. That the City has the responsibility of a 40% match for this grant, and funds have been encumbered from the 2012 Appropriations totalling $175,500 in Account No. 631.350.5596, Stormwater Capital Projects/Improvements, to cover the herein costs.
Section 3. That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
