Title

 

TO ALLOW THE PLACEMENT OF A SIGN WITHIN A CITY-OWNED RIGHT OF WAY; FOR PROPERTY LOCATED AT 765 NORTH HAMILTON ROAD, PRIME MEDICAL GROUP, APPLICANT

 

Body

 

WHEREAS, Prime Medical Group has opened a new health care facility at 765 North Hamilton Road; and

 

WHEREAS, a hardship exists with the slope of the driveway and remaining berm area for the placement of a sign; and

 

WHEREAS, Planning Commission approved sign locations by V-54-97 which included the placement of the Hamilton Road sign; and

 

WHEREAS, upon proceeding with the siting for the placement of said sign it was determined that the approved location would not serve the necessary purpose of directing people onto the site; and

 

WHEREAS, Prime Medical Group submitted an amended application for approval of its signage and requested that the Hamilton Road sign be placed within the right of way; and

 

WHEREAS, Planning Commission reviewed said application, made on site inspections, and has recommended approval of the sign within the right of way;

 

NOW, THEREFORE, BET IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA,  STATE OF OHIO:

 

Section 1.  Under the authority of Section 1165.08(b) of the Codified Ordinances of the City of Gahanna, the placement of a sign is hereby authorized at the location on Hamilton Road as delineated on the drawing attached as EXHIBIT A.

 

Section 2.  That it is understood that if Hamilton Road is widened the cost of relocating the sign out of the right of way will be paid by Prime Medical Group as outlined in their letter attached as EXHIBIT B.

 

Section 3.  That this ordinance shall go into effect at the earliest period allowed by law.
