TO AUTHORIZE THE MAYOR TO EXECUTE CROSS ACCESS EASEMENT WITH THE MOST REVEREND JAMES A GRIFFIN, BISHOP OF COLUMBUS FOR THE ST. MATTHEW ATHLETIC FIELDS LOCATED ADJACENT TO BIG WALNUT CREEK AND THE GAHANNA JEFFERSON LOCAL SCHOOL DISTRICT RECREATION COUNCIL PROPERTY ON PARKLAND DRIVE

WHEREAS, The Most Reverend James A. Griffin, Bishop of Columbus has purchased approximately 11.092 acres from the Jefferson Local School District Recreation Council; and
WHEREAS, that 11.092 acre parcel will be used for athletic fields for the St. Matthew athletic programs; and
WHEREAS, there is a forested part of the 11.092 acres that lays along Big Walnut Creek that is unsuitable for athletic fields; and
WHEREAS, the City of Gahanna has need for access to the lands that border Big Walnut Creek to the south, projected as future park land; and
WHEREAS, the Bishop is willing to extend an easement of 1.645 acres through the forested area along Big Walnut Creek to the City, so as to obtain a southern access to those future parklands; and
WHEREAS, the City will provide maintenance services specified in the agreement in exchange for this cross access easement; and
WHEREAS, the City will provide a perpetual nonexclusive easement for the purpose of vehicular and pedestrian ingress and egress to the athletic field site;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into a Cross Access Easement with The Most Reverend James A. Griffin, Bishop of Columbus so as to establish a perpetual nonexclusive easement across both the City owned 2.618 acre parcel and the 1.645 acre parcel owned by the Bishop, said easement attached hereto as EXHIBIT A.
Section 2. That this ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
