WHEREAS, Mark and Emmy Urban, residents of 533 E. Johnstown Road, own this property which has a history of drainage problems; and

 

WHEREAS, the owner wishes to obtain city water, and has offered to exchange a conservation easement on this property in return for tap-in fees; and

 

WHEREAS, said fees will amount to approximately $7,110;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into Deed of Conservation Easement with Mark and Emmy Urban, the owners of 533 East Johnstown Road, said document attached to this ordinance as EXHIBIT A, and made a part herein.

 

Section 2.  That this Council hereby waives tap-in fees and accompanying charges for 533 East Johnstown as compensation for this Deed of Conservation Easement.

 

Section 3.  That SEVEN THOUSAND ONE HUNDRED TEN DOLLARS ($7,110) is hereby supplementally appropriated from the unencumbered,  unappropriated balance of the Capital Improvement Fund to Account Number 325.111.5531, Land Purchase, in order to reimburse the water fund for the waiver of said fees.

 

Section 4.  That ORD-0001-2001, passed January 2,2001, is hereby amended to reflect this supplemental appropriation.

 

Section 5.  That this ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
