TO AUTHORIZE THE MAYOR TO ENTER INTO CHANGE ORDER AGREEMENT WITH MILLER PAVEMENT FOR ADDITION TO THE 2003 STREET REPAIR PROGRAM, IMPROVEMENT NO. 838, OF WORK ON PRICE ROAD; TO SUPPLEMENTALLY APPROPRIATE $9,670; AND TO DECLARE AN EMERGENCY.

WHEREAS, Price Road needs to have two culverts installed and in the urban area it is justified to upgrade the drainage system with the paving; and
WHEREAS, the upgrade can be accomplished by adding the Price Road culvert installation to the 2003 Street Repair Program; and
WHEREAS, ORD-0135-2003 awarded the 2003 street repair program to Miller Pavement; and
WHERES, it is imperative to move forward with this as soon as possible, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into change order Agreement with MILLER PAVEMENT, 1771 Harmon Avenue, Columbus, Ohio 43223, for the 2003 Street Repair Program, Improvement No. 838, to add Price Road culvert installation, in accordance with City specifications.
Section 2. That funding in the amount of NINE THOUSAND SIX HUNDRED SEVENTY DOLLARS ($9,670) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.145.5541, Capital Projects, Streets, to cover the herein costs.
Section 3. That ORD-0001-2003 passed January 1, 2003, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and will be in full force and effect immediately after passage by this Council and on date of signature approval by the Mayor.
