TO AUTHORIZE THE MAYOR TO ENTER INTO CHANGE ORDER AGREEMENT WITH THE RIGHTER CO., INC., FOR BIG WALNUT BRIDGE MODIFICATIONS, IMPROVEMENT NO. 728; TO SUPPLEMENTALLY APPROPRIATE $80,117 THEREFOR; AND TO DECLARE AN EMERGENCY.

WHEREAS, The Righter Co., iNC., has been the contractor for the bridge modifications over Big Walnut; and

 

WHEREAS, Council has been advised of varying unforseen complications of this project with misplaced conduits by Ameritech which, in turn, caused other untimely delays; and

 

WHEREAS, with the project underway and yet unfinished, it is desirable and necessary to complete this beneficial project as soon and as efficiently as possible, all for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into Change Order Agreement with THE RIGHTER CO., INC., 2424 Harrison Road, Columbus, Ohio 43204-3508, for completion of the Walnut Bridge modifications, with originating Ordinance 990361 herein referenced as EXHIBIT A, with all work under this Change Order Agreement to continue to be in accordance with City specifications.

 

Section 2.  That the amount of EIGHTY THOUSAND, ONE HUNDRED SEVENTEEN DOLLARS ($80,117) is hereby supplementally appropriated from the unencumbered, unappropriated balance in the General Fund to ACCOUNT NO. 101.343.5511, CAPITAL PROJECTS, DEVELOPMENT, to cover the herein costs.

 

Section 3.  That Ordinance No. 200001, passed January 3, 2000, is hereby amended to reflect this supplemental appropriation.

 

Section 4.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and upon date of signature approval by the Mayor.
