AN ORDINANCE AMENDING ORDINANCE NO. 990164, PASSED BY THE CITY ON AUGUST 16, 1999 AND ORDINANCE NO. 990427 PASSED BY THE CITY ON SEPTEMBER 20, 1999; RATIFYING AN INFRASTRUCTURE AGREEMENT INCLUDED IN THE PRIOR LEGISLATION; TO AUTHORIZE THE MAYOR TO ENTER INTO ADDENDUM TO INFRASTRUCTURE AGREEMENT; AND TO DECLARE AN EMERGENCY

WHEREAS, it has been and is in the best interests of the City to designate certain areas for commercial and other business development; and
WHEREAS, in furtherance of the City's objectives and utilizing the powers conferred by the Ohio Revised Code, the City by Ordinance 990427, passed Spetember 20, 1999 designated an area within the City as the Eastgate Industrial Center TIF District; and
WHEREAS, to facilitate the development of projects within that TIF District, the City approved and entered into the Infrastructure Agreement (Eastgate Industrial Park Improvements) dated December 30, 1999 with Pizzuti Properties/Eastgate Limited to provide for the construction of certain of public infrastructure improvements; and
WHEREAS, the Agreement originally provided that the City would be obligated to pay for the costs of those public infrastructure improvements in an amount not to exceed $2,630,950; and
WHEREAS, this Council now finds that additional public infrastructure improvements including, but not limited to the widening of Taylor Road at its intersection with Eastgate Drive, together will all necessary appurtenances are necessry to facilitate development within the TIF District and has determined to authorize the payment of additional monies in ana mount not to exceed $269,050 for the payment of those additional publci improvements and to authorize the execution of any necessary and related agreements; and
WHEREAS, ORD-0120-2002 has supplementally appropriated the necessary funds to pay for these additional public improvements; and
