TO AUTHORIZE THE MAYOR TO ENTER INTO LICENSE AGREEMENT WITH DHB NETWORKS, LTD., FOR INSTALLATION OF A WIRELESS SYSTEM IN THE CITY OF GAHANNA'S RIGHTS-OF-WAY AND TO OFFER WIRELESS COMMUNICATION SERVICES TO GAHANNA RESIDENTS AND BUSINESSES; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City wishes to install a wireless system in the City's rights-of way and to offer wireless communication service to residents and businesses; and
WHEREAS, to proceed it is necessary to enter into license agreement with DHB Networks; and
WHEREAS, it is imperative to move forward, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into License Agreement with DHB NETWORKS, LTD., 4338 Bright Road, Dublin, Ohio 43016, to allow a wireless system in the City of Gahanna's rights-of way and to offer wireless communication services to Gahanna residents and businesses; License Agreement attached as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
