TO AUTHORIZE THE MAYOR TO ENTER INTO AN ADDENDUM TO CONTRACT WITH NICKOLAS SAVKO & SONS, INC., FOR THE EAST INDUSTRIAL SANITARY SEWER, IMPROVEMENT NO. 727; TO SUPPLEMENTALLY APPROPRIATE $2,389; AND TO DECLARE AN EMERGENCY.

WHEREAS, a contract was awarded by ORD-0049-2001 to Nickolas Savko & Sons, Inc. for the East Industrial Sanitary Sewer, Improvement No. 727 and amended by ORD-0072-2003; and
WHEREAS, change orders are being requested for installation of a drain tile to divert groundwater flow that has been altered; and
WHEREAS, it is imperative to move forward with this project, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into an addendum to contract with Nickolas Savko & Sons Inc., 4636 Shuster Road, Columbus, Ohio, 43214, for a change order for the East Sanitary Sewer, Improvement No. 727, in accordance with EXHIBIT A attached hereto.
Section 2. That funding in the amount of TWO THOUSAND THREE HUNDRED EIGHTY NINE DOLLARS ($2,389) is hereby supplementally appropriated from the unappropriated, unencumbered balance in the SSCI Fund to Account No. 662.361.5821, Capital Projects, Sewer TIF, to cover the herein costs.
Section 3. That ORD-0001-2003, passed January 2, 2003, is hereby amended to reflect this supplemental appropriation.
Section 4. That for the reasons set forth in the preamble herein above this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
