TO AMEND SECTION 1325.08, FENCE REQUIRED, OF CHAPTER 1325, SWIMMING POOLS, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; AND TO DECLARE AN EMERGENCY.

WHEREAS, a review of the Code section with regard to swimming pool fences was undertaken at the request of Council in late 1998; and
WHEREAS, a revision to Chapter 1171, Fences was passed on February 7, 2000 and is effective on March 9, 2000; and
WHEREAS, with the delay in passing the amendment to the fence code the necessity of also making amendment to Chapter 1325 was overlooked; and
WHEREAS, it is imperative for the orderly flow of City business to have these two related code sections match as quickly as possible, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That Section 1325.08, of Chapter 1325, Swimming Pools, is hereby amended as set forth in EXHIBIT A, attached hereto and made a part herein.
Section 2. That existing Section 1325.08, of Chapter 1325, Swimming Pools, or any ordinances or parts of ordinances in conflict herewith, is hereby repealed.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
