TO AUTHORIZE THE MAYOR TO ENTER INTO MODIFICATION, ASSIGNMENT AND ASSUMPTION AGREEMENT WITH BATTLE CREEK HEALTH SYSTEM TO ASSUME OUR EMPLOYEE ASSISTANCE PROGRAM EFFECTIVE AUGUST 10, 2010; AND TO DECLARE AN EMERGENCY.

WHEREAS, Mount Carmel Health System is discontinuing its EAP services effective August 10, 2010; and
WHEREAS, HelpNet, a subsidiary of Battle Creek Health Systems, will assume our current contract, but first the City must enter into Modification, Assignment and Assumption Agreement with them; and
WHEREAS, it is imperative to move forward with this Agreement so that it can be in place by August 10, 2010 so there will be no lapse in service, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Modification, Assignment and Assumption Agreement with Battle Creek Health System, to assume the City of Gahanna Employee Assistance Program effective August 10, 2010 and continue through June 30, 2011; Agreement attached as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance shall be declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
