WHEREAS, the City of Gahanna has been designated an NPDES Phase II community by the U.S. Environmental Protection Agency within its Phase II Final Rule published in the Federal Register on December 8, 1999 (64 FR 687222), and

WHEREAS, the City of Gahanna is required to submit to the State of Ohio EPA for coverage under the "Authorization For Small Municipal Storm Sewer Systems Located Within Rapidly Developing Watersheds To Discharge Storm Water Under That National Pollutant Discharge Elimination System" - Permit Number OHQ100000, no later than March 10, 2003, and

WHEREAS, the Council of the City of Gahanna recognizes that all Notices of Intent, Storm Water Management Plans, reports, certifications or information submitted to the Ohio EPA must be signed by either a principal executive officer or ranking elected official, and

WHEREAS, the City of Gahanna desires to comply with the NPDES Phase II storm water regulations, and

WHEREAS, it is desirable and necessary to move forward with this at the earliest possible date in order to submit the application in a timely manner, all for the preservation of the public peace, health, safety and welfare;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

Section 1. That the Council of the City of Gahanna hereby adopts and supports the Storm Water Management Plan attached hereto, which is designed to provide a means by which the City of Gahanna will meet the requirements of Permit Number OHQ100000.

Section 2. That the Council of the City of Gahanna authorizes the Mayor to serve as the principal executive officer for the storm water management utility for the purposes of fulfilling the signatory requirements of the EPA NPDES Phase II storm water program.
