Title

 

TO AUTHORIZE THE CITY ATTORNEY TO PETITION THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY, OHIO, TO ANNEX CERTAIN 13+/- ACRES FROM JEFFERSON TOWNSHIP KNOWN AS 4433 JOHNSTOWN ROAD; AND TO DECLARE AN EMERGENCY

 

Body

 

WHEREAS, it is the desire of the City of Gahanna to annex 13+/- acres known as 4433 Johnstown Road; and

 

WHEREAS, legal descriptions have been developed and it is necessary to proceed at the earliest possible date to annex these parcels for orderly development of this growth area of the City; and

 

WHEREAS, Section 709.14 of the Ohio Revised Code requires that a representative be appointed by the City to prosecute said annexation proceedings; and

 

WHEREAS, an emergency exists in the usual daily operation of the City to immediately annex the herein described land, thereby preserving the public peace, health, property, safety and welfare of the residents;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA,  STATE OF OHIO:

 

Section 1.  That it is necessary and in the best interest of the City of Gahanna to annex 13+/- acres known as 4433 Johnstown Road, said acreage more particularly described in Exhibit A which includes Exhibit AA, Exhibit BB, Exhibit CC and Exhibit DD, attached to this ordinance and made a part herein.

 

Section 2.  That the City Attorney is authorized and directed to effect all documentation necessary for completion of this annexation before the Board of  County Commissioners of Franklin, County, Ohio.

 

Section 3.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
