TO GRANT VARIANCE FROM SECTION 1109.08 (b) OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; TO ALLOW CONSTRUCTION TO ENLARGE THE GIANT EAGLE DETENTION BASIN ON DEDICATED PARKLAND FOR REQUIRED STORMWATER MANAGEMENT FOR THE GIANT EAGLE BASIN; 500 STONERIDGE DRIVE; AND TO DECLARE AN EMERGENCY.

WHEREAS, over the past 20 years farm land on the northern edges of the City and also to the north of Morse Road has been converted to dense urban development; and
WHEREAS, this has caused a large increase in storm water flows in McKenna Creek and has caused serious flooding in the area of Giant Eagle and Shagbark Road, rising to a level in yards where it threatens structures, brings down trees and to the point of overtaking the bridge over McKenna Creek; and
WHEREAS, the City, over the last four years, has explored various measures to reduce the problem and have found the most feasible solution is the expansion of the Giant Eagle detention basin; and
WHEREAS, this solution would divert the high flows from the creek into the basin to be detained reducing the peak one year interval flows by 48 percent and the peak 100 year interval flows by 33 percent; and
WHEREAS, our stormwater code was changed after the detention basin was built and therefore to pursue this solution a variance is needed to allow a detention basin to be enlarged and/or constructed on dedicated parkland; and
WHEREAS, on August 24, 2011, Planning Commission, after careful deliberation and discussion voted unanimously to recommend approval of this variance; and
WHEREAS, under authority of Section 1103.03, this variance request must be approved by Council after a recommendation is made by Planning Commission; and
WHEREAS, it is imperative to proceed as quickly as possible so work can begin on the basin yet this construction season for the safety of the citizens of Gahanna, and all for the preservation of the public peace, property, health, safety and wel...
