TO VACATE A SLOPE EASEMENT FOR PROPERTY LOCATED AT 701 TECHCENTER DRIVE, A PORTION OF LOT 3 OF TECH CENTER COMMONS

WHEREAS, it was necessary to establish slope easements along Techcenter Drive to protect the integrity of the road prior to development; and
WHEREAS, the slope easement for all of Techcenter Drive was accepted by ORD-197-2010; and
WHEREAS, the site grading that was recently approved for the Eastside Urological Center at 701 Techcenter Drive by FDP 0008-2011 was such that the slope easement is no longer needed; and
WHEREAS, the City Engineer has requested that this slope easement be vacated; and
WHEREAS, Planning Commission has reviewed and recommended that the slope easement be vacated at their regular meeting held November 6, 2013; and
WHEREAS, the remaining slope easement along Techcenter Drive is still required until future development plans require otherwise;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the slope easement located on the property at 701 TechCenter Drive, which is a portion of Lot 3 of Tech Center Commons, more particularly described in EXHIBIT A attached to this ordinance and made a part herein, is hereby vacated.
Section 2. That this ordinance shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
