AN ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR THE IMPROVEMENT OF CERTAIN AREAS WITHIN THE CITY OF GAHANNA BY CONSTRUCTING AND INSTALLING THE LARRY LANE SANITARY SEWER; IMPROVEMENT NO. SA 1013; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City of Gahanna still has several unsewered areas and one of them is along East Johnstown Road, and the City has determined that an assessment process is needed and an ordinance determining to proceed with the assessment is necessary; and

WHEREAS, it is imperative to move forward with this ordinance for the safety of Gahanna residents, and all for the preservation of the public peace, property, health, safety and welfare;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

Section 1. That the assessment of the cost and expense of improving certain areas within the City of Gahanna by
constructing and installing the Larry Lane Sanitary Sewer, Improvement No. SA 1013 shall be and the same is hereby adopted and confirmed and there shall be and are hereby levied and assessed upon the properties in the amount reported as attached in EXHIBIT A, and made a part herein, and on file in the office of the Clerk of Council, which assessment is a special benefit and is not in excess of any statutory limitation.

Section 2. That this Council hereby finds and determines that the Assessments as now on file in the office of said clerk are no more than in proportion to the estimated assessments as originally filed as the actual costs of the above described improvement is to the estimated cost of the improvement as originally filed.

Section 3. That the Assessment against each lot or parcel of land shall be payable in cash within thirty (30) days after the passage of this ordinance unless such cash payment period shall be waived by the owner for such lot or parcel, or, at the option of such owner, in twenty (20) annual installments with interest at the same rate presentl...
