TO ACCEPT DEEDS OF EASEMENT FOR WATER LINE PURPOSES FOR PROPERTY LOCATED ON GRANVILLE STREET; PROPERTY FORMERLY KNOWN AS GAHANNA SHOPPING CENTER; FROM TEMPO III PARTNERSHIP AND CHARLES SHULL.

 

Body

 

WHEREAS, easements for construction, using and maintaining a water line and appurtenant works on Granville Street, property previously known as Gahanna Shopping Center, were obtained in 1972 from Tempo III Partnership; and

 

WHEREAS, said utility easements from Tempo III were recorded on August 31, 1972 and October 25, 1972 by the Franklin County Recorder's Office; and

 

WHEREAS, an easement for construction, using and maintaining a water line and appurtenant works on Granville Street, property previously known as Gahanna Shopping Center, was obtained in 1961 from Charles Shull; and

 

WHEREAS, said utility easement from Charles Shull was recorded on August 14, 1961 by the Franklin County Recorder's Office; and

 

WHEREAS, said utility easements were never accepted by the City of Gahanna;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That this Council hereby accepts Deeds of Easement from Tempo III Partnership, for water line purposes in property formerly known as Gahanna Shopping Center and located on Granville Street said land more particularly described in EXHIBIT A and EXHIBIT B attached hereto and made a part herein.

 

Section 1.  That this Council hereby accepts Deed of Easement from Charles Shull, for water line purposes in property formerly known as Gahanna Shopping Center and located on Granville Street said land more particularly described in EXHIBIT C attached hereto and made a part herein.

 

Section 3.  That this ordinance shall be in full force and effect at the earliest period allowed by law.
