TO AUTHORIZE THE CITY ATTORNEY TO PETITION THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY, OHIO, TO ANNEX CERTAIN 2.623+/- ACRES FROM JEFFERSON TOWNSHIP KNOWN AS 4491 EAST JOHNSTOWN ROAD; AND TO DECLARE AN EMERGENCY.

WHEREAS, it is the desire of the City of Gahanna to annex 2.623+/- acres known as 4491 East Johnstown Road ; and

 

WHEREAS, legal description has been developed and it is necessary to proceed at the earliest possible date to annex this parcel for orderly development of this growth area of the City; and

 

WHEREAS Section 709.14 of the Ohio Revised Code requires that a representative be appointed by the City to prosecute said annexation proceedings; and

 

WHEREAS, an emergency exists in the usual daily operation of the City to immediately annex the herein described land, thereby  preserving the public peace, health, property, and safety, and peace of the residents;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA:

 

Section 1.  That is necessary and in the best interest of the City of Gahanna to annex 2.623+/- acres known as 4491 East Johnstown Road, said acreage more particularly described in Exhibit A, attached to this ordinance and made a part herein.

 

Section 2.  That the City Attorney is authorized and directed to effect all documentation necessary for completion of this annexation before the Board of County Commissioners of Franklin County, Ohio.

 

Section 3.  That for the reasons set forth in the preamble herein above this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
