TO AUTHORIZE THE MAYOR TO ENTER INTO AMENDED CONTRACT WITH ME COMPANIES FOR PURCHASE AND PAYMENT FOR RIGHT OF WAY ON OGDEN ALLEY; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0234-2202 authorized a contract with ME Companies for right of way acquisition services for the Ogden Alley Improvement, Imp. #774; and

 

WHEREAS, ORD-0053-2003 amended this contract to include appraisal, title work, negotiations and recording; and

 

WHEREAS, the negotiations are now complete and authorization is now needed to purchase and pay for this right of way; and

 

WHEREAS, it is prudent to proceed to authorize the purchase of this property at this time for the continuation of the orderly redevelopment of the downtown area, all for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into amended contract with ME Companies, 635 Brooksedge Boulevard, Westerville OH  43081 for the purchase and payment for right of way for the Ogden Alley Improvement, Imp. #774 as shown on EXHIBIT A attached hereto.

 

Section 2.  That the amount of FORTY ONE THOUSAND DOLLARS ($41,000) was appropriated to Account #325.122.5548, Capital Improvements, in the 2003 appropriations for this acquisition.

 

Section 3.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
