TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH R. D. ZANDE FOR RIGHT OF WAY ACQUISITION FOR THE JOHNSTOWN ROAD/BEECHER INTERSECTION, IMPROVEMENT NO. 709; AND TO DECLARE AN EMERGENCY.

WHEREAS, it is necessary to obtain rights of way for ten properties in order to proceed with the improvements to the Johnstown Road/Beecher Road Intersection, Improvement No. 709; and
WHEREAS, proposal has been received and had been recommended by the City Engineer and it is necessary to proceed at the earliest possible date to procure said rights of way in order to keep the improvements to this important intersection on schedule, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Contract with R. D. Zande for right of way acquisition for the Johnstown Road/Beecher Intersection Project, Improvement No. 709, in accordance with Cost Proposal submitted under date of January 18, 1999, and in accordance with City specifications, said Cost Proposal attached to this ordinance as EXHIBIT A.
Section 2. That funding in the amount of $12,500 was set aside in the 1999 Appropriations to Account No. 101.145.5541, Capital Projects, Streets, to cover the herein costs.
Section 3. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
