AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO CONTRACT FOR THE 2021 FISCAL YEAR WITH THE FRANKLIN COUNTY PUBLIC DEFENDER COMMISSION TO REPRESENT INDIGENT PERSONS BEFORE THE FRANKLIN COUNTY MUNICIPAL COURT CHARGED WITH VIOLATIONS UNDER GAHANNA ORDINANCES.

WHEREAS, pursuant to Ohio Revised Code, Section 120.14(E), the City may authorize the Franklin County Municipal Court to represent indigent persons before the Franklin County Municipal Court charged under Gahanna Ordinances; and

 

WHEREAS, Under the new contract, the City would pay the Commission at a rate of $54.69/case, which is an 18.75% increase over last year’s $46.06/case price; and

 

WHEREAS, In 2020, the Public Defender’s Office represented eleven (11) cases for a total expenditure of $506.66.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into contract with Franklin County Public Defender Commission for the representation of indigent persons coming before the Franklin County Municipal Court, Criminal Division, charged with a violation of an Ordinance of the City of Gahanna; said Contract attached as EXHIBIT A, and made a part herein.

 

Section 2.  That the Contract is effective retroactive to January 1, 2021.

 

Section 3.  That this Ordinance shall be in full force and effect upon passage by this Council and 30 days after date of signature approval by the Mayor.
