TO ACCEPT GENERAL WARRANTY DEED FROM GAHANNA RETIREMENT RESIDENCE LLC, FOR RIGHT OF WAY ON EAST JOHNSTOWN ROAD SOUTHWEST OF RIVA RIDGE COURT; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City of Gahanna has received a General Warranty Deed for right of way purposes from Gahanna Retirement Residence, LLC for a 10' strip along East Johnstown Road southwest of right Riva Ridge Court; and
WHEREAS, this deed was recorded by the Franklin County Recorder's office on March 3, 2006; and
WHEREAS, the City Engineer has determined the value of this right of way
to be $25,000; and
WHEREAS, it is desirable and necessary to accept this Deed; and
WHEREAS, it is imperative to accept this deed at the earliest possible date, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby accepts this GENERAL WARRANTY DEED for the purpose of street right of way on East Johnstown Road southwest of Riva Ridge Court, from Gahanna Retirement Residence LLC; said deed and legal description attached to this ordinance as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council, and on date of signature approval by the Mayor.
