TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH S. VITALE PYROTECNICO INDUSTRIES INC., FOR FIREWORKS FOR THE CITY OF GAHANNA 2012 FOURTH OF JULY FIREWORKS DISPLAY; TO SUPPLEMENTALLY APPROPRIATE $19,380; AND TO DECLARE AN EMERGENCY.

WHEREAS, due to the financial challenges for 2012 the Parks & Recreation appropriations did not include funding for the Freedom Festival which includes the fireworks display; and
WHEREAS, it is imperative to move forward with this ordinance so that everything will be in place for the Fourth of July Fireworks display, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into contract with S. VITALE PYROTECNICO INDUSTRIES, INC., P.O. Box 149, New Castle, PA 16103, to furnish and launch fireworks for the Gahanna Freedom Festival; contract attached as EXHIBIT A, and made a part herein.
Section 2. That funding in the amount of NINETEEN THOUSAND THREE HUNDRED EIGHTY DOLLARS ($19,380) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.432.4515, Fourth of July, to cover the herein costs.
Section 3. That ORD-0001-2012, passed January 2, 2012, is hereby amended to reflect this supplemental appropriation.
Section 4. That second reading of this ordinance is hereby waived.
Section 5. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
