TITLE
AN ORDINANCE ACCEPTING A DEED OF EASEMENT FOR PARCEL NO. 025-01376700 FROM CP CRESCENT, LLC, ASSOCIATED WITH THE PIZZURRO PARK WATERLINE IMPROVEMENTS, WAIVING SECOND READING, AND DECLARING AN EMERGENCY
BODY
WHEREAS, public waterline improvements were previously installed in the area near Pizzurro Park and the Buckles Tract (ST-646); and
WHEREAS, the easement for the work inadvertently was not recorded and must now be recorded in order to allow the City to operate and maintain public infrastructure and to allow further development of adjacent parcels; and
WHEREAS, to support the utilities as described, an easement of is needed for the property identified by Franklin County as Parcel No. 025-01376700; and
WHEREAS, the Administration recommends passage of this Ordinance with waiver of second reading and declaration of an emergency immediately necessary for the preservation of public peace, safety, health, and welfare of the City to ensure that correct documentation is filed in light of ongoing development in the area.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That this Council hereby accepts the Deed of Easement from CP Crescent, LLC, for Parcel No. 025-01376700 for public waterlines thereon; said Deed of Easement more particularly described in EXHIBIT A attached hereto and made a part herein.
Section 2. That for the reasons set forth in the preamble, the second reading is hereby waived, and this Ordinance is declared an emergency measure which shall be in full force and effect immediately upon passage by this Council and on date of signature of approval by the Mayor.
