Title

TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH CODY ZIEGLER, INC. FOR THE BIG WALNUT PEDESTRIAN ACCESS; TO SUPPLEMENTALLY APPROPRIATE ADDITIONAL $538,399 THEREFOR; AND TO DECLARE AN EMERGENCY

WHEREAS, bids were received July 22, 1998, and the Director of Public Service has recommended the lowest responsive and responsible contractor to this Council; and

 

WHEREAS, in order to accomplish the designated time table for this project, it is necessary to proceed at the earliest possible date during this construction season for the orderly accomplish of this project, all for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Director of  Public Service is hereby authorized to award and the Mayor to enter into contract with CODY ZEIGLER, INC., 6500 Taylor Road S.W. P. O. Box 200, Summit Station, Ohio 43073 for the Big Walnut Pedestrian Access Restoration, Improvement No. 708, for the amount, as modified, of Seven Hundred Ninety-seven Thousand Dollars in accordance with bid specifications and City specifications.

 

Section 2.  That the additional amount of Five Hundred Thirty-eight Thousand Three Hundred Ninety-nine Dollars ($538,399) is hereby supplementally appropriated from the unencumbered, unappropriated balance in The General Fund to Account No. 101.145.5541, Capital Projects, Streets, to cover the herein costs.

 

Section 3.  That Ordinance No. 980001, passed January 2, 1998, is hereby amended to reflect this supplemental appropriation.

 

Section 4.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
