WHEREAS, this summer the County paved a portion of Clark State Road in the corporate limits of Gahanna and this portion was eligible for the use of County Permissive Tax; and
 
WHEREAS, $44,680 was disbursed to the City and deposited in the City Permissive tax fund to pay for the work, and of these funds $36,326 was used for the project; and
 
WHEREAS, the remainder of the funds need to be returned to the County to be deposited in the County Permissive Tax fund; and
 
WHEREAS, legislation is also needed to authorize the payment to the County; and
 
WHEREAS, it is imperative to move forward with this Ordinance in order to return said monies to the City Permissive Tax Fund, and all for the preservation of the public peace, property, health, safety and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That funding in the amount of FORTY FOUR THOUSAND SIX HUNDRED EIGHTY DOLLARS ($44,680) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the County Permissive Tax fund, to Account No. 231.330.5596, Permissive Tax Fund Capital Projects/Improvements to cover the herein cost.
 
Section 2.  That payment to Franklin County is hereby authorized as the funds were not encumbered prior to the services rendered.
 
Section 3.  That ORD-0001-2014, passed January 2, 2014, is hereby amended to reflect this supplemental appropriation.
 
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
