TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH DONALD R. KENNEY FOR REIMBURSEMENT FOR CONSTRUCTION OF EAST INDUSTRIAL SANITARY SEWER, IMPROVEMENT NO. 727; TO PROVIDE $300,000 THEREFOR; AND TO DECLARE AN EMERGENCY.

WHEREAS, Donald R. Kenney has agreed to grant an easement to the City of Gahanna for purposes of constructing a sanitary sewer within his property along Taylor and Taylor Station Roads which in future development will be known as Crossroads Commerce Center; and
WHEREAS, Donald R. Kenney has agreed to construct the sanitary sewer required by this development and tie into a 15" sanitary sewer line; and
WHEREAS, the cost differences developing from this construction to City specifications will be borne by the City of Gahanna and reimbursed to Donald R. Kenney; and
WHEREAS, due to the forthcoming building season, it is desirable and necessary to proceed with this authorization at the earliest possible date for the orderly development of this area, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into "Reimbursement Agreement for Construction of East Industrial Sanitary Sewer, Improvement No. 727," for an amount not to exceed Three Hundred Thousand Dollars ($300,000).
Section 2. That the amount of THREE HUNDRED THOUSAND DOLLARS ($300,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance in S.S.C.I to ACCOUNT NO. 662.361.5543, SANITARY SEWER, to cover the herein costs.
Section 3. That said Agreement authorized herein is attached to this ordinance as EXHIBIT A, and made a part herein.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage ...
