WHEREAS, the City of Gahanna through ORD-0129-2006 committed to complete stormwater improvements in the Bedford 1 CORF project area; and

WHEREAS, the City of Gahanna desires to obtain a loan from the Ohio Water Development Authority to finance costs of the planning of such facilities on the terms set forth in the Cooperative Agreement; and

WHEREAS, the Ohio Water Development Authority has indicated its willingness to make a loan for that purpose and on those terms; and

WHEREAS, the immediate construction of the stormwater project at the earliest possible time is necessary in order to protect the health of the inhabitants of the City of Gahanna by providing stormwater protection, and all for the preservation of the public peace, health, safety, and welfare;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

Section 1. That the City of Gahanna hereby approves the planning of the aforesaid stormwater project in cooperation with the Ohio Water Development Authority under the provisions, terms and conditions set forth in the "Cooperative Agreement for State Planning Project" as set forth in Exhibit A and hereby authorizes the Mayor and the Director of Finance of the City of Gahanna to execute the Cooperative Agreement with the Ohio Water Development Authority substantially in the form set forth in Exhibit A.

Section 2. That it is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were passed in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requ...
