TO AUTHORIZE THE CITY ATTORNEY OR HIS DESIGNEE TO FILE AN ANNEXATION PETITION FOR THE ANNEXATION OF 3.4+/- ACRES OF PROPERTY FROM JEFFERSON TOWNSHIP; SAID PROPERTY LOCATED AT 5061 SHAGBARK ROAD, JACK A. AND SUE WILLIAMS, OWNERS AND 1150 NORTH HAMILTON ROAD, ROBERT L. ROSHON, ET AL OWNERS; AND TO DECLARE AN EMERGENCY.

WHEREAS, as part of a settlement for an easement for the Triangle West Sanitary Sewer extension, the owners of 5061 Shagbark Road, Jack A. & Sue Williams, have requested that their parcel of 2.45+/- acres be annexed to the City of Gahanna; and
WHEREAS, the owners of the property located at 1150 N. Hamilton Road, Robert L. Roshon, et al, have requested that their 1.0+/- acre parcel also be annexed; and
WHEREAS, a legal description has been developed and it is necessary to proceed at the earliest possible date to annex this parcel for the orderly development of this growth area of the City; and
WHEREAS, Section 709 of the Ohio Revised Code requires that a representative be appointed by the City to prosecute proceedings; and
WHEREAS, it is in the best interest of the City to complete this process before the end of year so that the procedure is completed during the current term of the City Attorney; and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That it is necessary and in the best interest of the City of Gahanna to annex said 3.4+/- acres located at 5061 Shagbark Road and 1150 N. Hamilton Road; said acreage more particularly described in EXHIBIT A, attached to this ordinance and made a part herein.
Section 2. That the City Attorney or his designee is authorized and directed to effect all documentation necessary for the completion of this annexation before the Board of County Commissioners of Franklin County, Ohio.
