WHEREAS, the City of Gahanna has an existing optical fiber system throughout Gahanna; and
WHEREAS, the Gahanna Jefferson School District has requested use of fiber through our fiber network; and
WHEREAS, the City is willing to provide optical fiber strands and to grant Gahanna Jefferson Schools an Indefeasible Right of Use (IRU) through Optical Fiber Use Agreement; and
WHEREAS, it is imperative to move forward with this ordinance so that the schools can access the fiber as soon as possible, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into OPTICAL FIBER USE AGREEMENT, with the GAHANNA JEFFERSON CITY SCHOOL DISTRICT, 160 South Hamilton Road, for fiber strands within the City of Gahanna fiber network; Agreement attached as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date signature approval by the Mayor.
