WHEREAS, bids were opened for the 2010 Street Program on June 4, 2010; and

WHEREAS, the Director of Public Service has recommended we proceed with the lowest, most responsive and responsible bidder; and

WHEREAS, the work will include overlay of Hamilton Road from Allanby Court to Sycamore Woods condominiums, and Stygler Road from Prince of Wales Drive to the northern corporation boundary; and

WHEREAS, these two streets are eligible for County Permissive tax funds; and

WHEREAS, it is imperative to move forward so that work can be completed this summer, and all for the preservation of the public peace, property, health, safety and welfare;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

Section 1. That the Director of Public Service is hereby authorized to award and the Mayor is authorized to enter into contract with CHEMCOTE, INC., 7599 Fishel Drive, Dublin, Ohio 43016 for the 2010 Street Program, Improvement No. ST 956; bid tabs attached as EXHIBIT A, and made a part herein.

Section 2. That funding in the amount of FIVE HUNDRED NINETY TWO THOUSAND DOLLARS ($592,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the County Permissive Fund to Account No. 231.330.5596, Permissive Tax Fund, Capital Projects/Improvements, to cover the herein costs.

Section 3. That ORD-0001-2010, passed January 2, 2010, is hereby amended to reflect this supplemental appropriation.

Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approva...
