TO AUTHORIZE THE MAYOR TO ENTER INTO CHANGE ORDER AGREEMENT WITH MILLER PAVEMENT FOR ADDITION TO THE 2003 STREET REPAIR PROGRAM, IMPROVEMENT NO. 838, OF PARKING LOT PAVING IN THE CREEKSIDE AREA; TO SUPPLEMENTALLY APPROPRIATE $10,000; AND TO DECLARE AN EMERGENCY.

WHEREAS, when the original Creekside project was done, the City agreed with property owners between what is now the Old Bag of Nails and the Post Office to repave the parking lots in exchange for being able to stage the construction on those lots; and

 

WHEREAS, the owners have reminded the City that we need to fulfill that obligation; and

 

WHEREAS, it is imperative to move forward with this paving so that it can be completed before winter, all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into change order Agreement with MILLER PAVEMENT, 1771 Harmon Avenue, Columbus, Ohio 43223, for the 2003 Street Repair Program, Improvement No. 838, to add paving of parking lot between what is now the Old Bag of Nails and the Post Office, in accordance with City specifications.

 

Section 2.  That funding in the amount of TEN THOUSAND DOLLARS ($10,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.360.5511, Creekside, Capital Projects, to cover the herein costs.

 

Section 3.  That ORD-0001-2003, passed January 1, 2003, is hereby amended to reflect this supplemental appropriation.

 

Section 4.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and on date of signature approval by the Mayor.
