AN ORDINANCE TO ALLOW AN EXTENSION OF WAIVER TO SECTION 563.19, PETS, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA TO ALLOW PIZZURRO PARK TO BE USED FOR A POOCH PLAYGROUND.

WHEREAS, Section 563.19, Pets, allows for the creation of a Pooch Playground within fenced areas of a designated park; and
WHEREAS, by ORD-0178-2007 a waiver was granted to allow a trial of an off leash area in Pizzurro Park not in the confines of fencing as required by Section 563.19 of the Codified Ordinances; and
WHEREAS, it is the desire of the Parks & Recreation Department to extend this waiver for one additional year and the Parks & Recreation Board has recommended this extension of the waiver;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That a waiver to the requirements of Section 563.19, Pets, of the Codified Ordinances is hereby extended to allow dogs to be off leash in Pizzurro Park with or without the confines of fencing.
Section 2. That in accordance with Section 505.01 of the Codified Ordinances the owner or keeper of any domestic animal shall not permit that animal to be out of control at any time or place including Pizzurro Park.
Section 3. That this waiver will be in effect until December 31, 2009, but may be extended if brought back to Council for further approval.
Section 4. All other requirements of Section 563.19, Pets, of the Codified Ordinances will remain in place.
Section 5. That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
