WHEREAS, the City has determined a need to construct interchange ramp modifications at the IR270/SR317 (Hamilton Road) interchange; and

WHEREAS, it is imperative to move forward with this ordinance so that ODOT can program the project for Federal Highway Funding at their first quarterly meeting in 2006, all for the preservation of the public peace, health, safety and welfare;

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

Section 1. That the Mayor is hereby authorized to enter into LPA Agreement with the OHIO DEPARTMENT OF TRANSPORTATION for FRA-IR270-37.04 (SR317 HAMILTON ROAD RAMP MODIFICATIONS), PID NUMBER 80721; said Agreement attached hereto as EXHIBIT A.

Section 2. That being in the public interest, the LPA gives consent to the Director of Transportation to complete the above described project.

Section 3. That the LPA shall cooperate with the Director of Transportation in the above described project as follows:

The City hereby agrees to cooperate with the Director of Transportation of the State of Ohio in the planning, design and construction of the identified highway improvement project and grants consent to the Ohio Department of Transportation for its development and construction of the project in accordance with plans, specifications and estimates as approved by the Director;

The City agrees to assume and bear one hundred (100%) of the costs of preliminary engineering and right-of-way and utility relocation, if applicable. Further, the City agrees to assume and bear one hundred percent (100%) of the costs of construction less the amount of federal funds set aside by the Director of Transportation;
